A much-awaited court case by Apple customers against the giant phone company seems to be making progress. Consumer champion Justin Gutmann is on one side of the table representing consumers. While on the other, the Apple battery case is in the hands of the best corporate solicitors money can buy.
Battery Case Alleges Apple Concealed Information
The case brought on behalf of consumers, alleges that Apple concealed certain information from customers. Moreover, Justin Gutmann holds that it surreptitiously installed a power management tool which throttled performance. What follows is a summary of a Reuters report we link to below.
The phone company responded on May 2, 2023 that the case was baseless. It strongly denied that its iPhone batteries were defective. But it did admit that a few iPhone 6s were problematic for which it offered replacement batteries.
The company representative continued by explaining how Apple’s 2017 power management update worked. Its purpose was to manage demand on older batteries, or those with a low level of charge. And this in any case only reduced an iPhone 6s performance on average by 10%.
Gutmann Unimpressed by Apple’s Defense
Justin Gutmann representing consumers was unimpressed by Apple’s position. He asked London’s competition appeal tribunal to certify the Apple battery case, and allow it to proceed towards trial. He stated his clients had a strong case, because of a similar decision in the United States earlier.
The company should have been clearer and more upfront with iPhone users about battery health in 2019 he alleged. Why else would it have offered cheaper Apple battery replacements to affected customers in 2017?
Apple responded by citing the allegation that ‘not all batteries could deliver the peak power demanded in all circumstances at all times’. Surely, they said this was common to all battery-powered devices. This Apple battery case is by no means done and dusted as we shall surely see.
